Background and Experience
Mark Wendorff joined Castle & Associates in 2009. Mr. Wendorff has successfully represented business entities and individuals through all phases of civil litigation in the areas of construction, real property, commercial business transactions, partnership dissolutions, trademark infringement, employment, professional licensing, insurance and entertainment law. He has appeared on behalf of clients in Superior Court throughout California, in U.S. District Courts, U.S. Bankruptcy Courts, the California Office of Administrative Hearings, the California Court of Appeals, and in arbitration through the American Arbitration Association and the Independent Film and Television Alliance.
In public works and private construction cases, Mr. Wendorff has litigated contract disputes, false claim actions, payment bond and bid bond claims, mechanic’s liens and construction defect claims. In the matter of Universal Construction Maintenance Integration Company, Inc. v. Compton Unified School District, 2002 WL 849970 (Cal.App. 2 Dist.), Mr. Wendorff successfully defended a general contractor at trial when the District sued to recover against his client’s bid bond, then recovered attorney’s fees and defended the judgment on appeal. In the matter of Palomar Pomerado Health v. Rudolph & Sletten, Inc., Mr. Wendorff obtained a dismissal of a multi-million dollar false claims action against a construction manager, along with a complete retraction of all allegations made against his client.
Mr. Wendorff’s experience in real property litigation includes disputes over commercial property lease agreements, unlawful detainer, disputed purchase and sale transactions, easement and boundary line disputes, and ADA accessibility claims. In KC Investment Company v. Kovnatsky 2010 WL 716838 (Cal.App. 2 Dist.), Mr. Wendorff obtained summary judgment to recover rent owed to his client on a commercial lease and defended the judgment on appeal.
